Terms of Service

1. Acceptance of Terms

By accessing and using Pitch Rise ("the Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

These Terms of Service apply to all users of the Platform, including without limitation users who are browsers, students, educators, contributors of content, or contributors of information.

2. Description of Service

Pitch Rise is an adaptive learning platform that provides:

• Mathematics and reading exercises with adaptive difficulty
• AI-powered learning assistance and explanations
• Progress tracking and leaderboards
• Educational resources and guided learning paths
• Community features including cohorts and mentorship

3. User Accounts

3.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.2 Age Requirements

Users under the age of 13 must have parental or guardian consent to use the Platform. Users between 13 and 18 must have parental awareness of their use of the Platform.

4. User Conduct

You agree NOT to use the Platform to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Attempt to gain unauthorized access to any portion of the Platform or any other systems or networks
• Use automated means (bots, scrapers, etc.) to access the Platform without our express written permission

5. Intellectual Property Rights

5.1 Platform Content

The Platform and its original content, features, and functionality are owned by Pitch Rise and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 User Content

You retain all rights to any content you submit, post, or display on or through the Platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Platform.

6. Educational Use and Academic Integrity

Pitch Rise is designed to enhance learning through AI assistance. Users agree to:

• Use the Platform as a learning tool, not for cheating or academic dishonesty
• Follow their educational institution's policies regarding AI assistance
• Understand that AI-generated content should be used as guidance, not submitted as original work without proper attribution
• Take responsibility for verifying the accuracy of AI-generated information

7. Payments, Credits, and Subscriptions

7.1 General Payment Terms

Some features of the Platform require payment. By making a purchase, you agree to:

• Provide current, complete, and accurate billing and payment information
• Promptly update account and payment information as needed
• Pay all charges at the prices in effect at the time of purchase
• Be responsible for any applicable taxes

7.2 Credit System

Pitch Rise uses a credit-based system for certain features:

• Credits can be purchased or earned through platform activities and competitions
• Credits are non-transferable between accounts unless explicitly allowed
• Credits have no cash value and cannot be exchanged for cash
• Unused credits do not expire unless your account is terminated
• We reserve the right to modify credit values and earning rates with 30 days notice

7.3 Subscriptions

If you purchase a subscription:

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to subscription features until the end of your paid period
• We will notify you of any price changes at least 30 days before they take effect

7.4 Refund Policy

Our refund policy is as follows:

• Subscriptions: You may request a full refund within 7 days of your initial purchase if you are not satisfied. After 7 days, refunds are prorated based on unused time.
• Credit Purchases: Only unused credits may be refunded, and only within 14 days of purchase. Once credits have been spent or partially used, the remaining balance is non-refundable. Credits earned through activities, promotions, or contests are never refundable.
• Contest Winnings: Credits awarded as prizes from competitions or contests are non-refundable and non-transferable.
• Processing Time: Approved refunds are processed within 5-10 business days to your original payment method.

7.5 Payment Processing

All payments are processed securely through Stripe. We do not store your full credit card information on our servers. By making a payment, you also agree to Stripe's Terms of Service.

8. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION:

• That the Platform will be uninterrupted, timely, secure, or error-free
• That the results obtained from the use of the Platform will be accurate or reliable
• That the quality of any products, services, information, or other material obtained through the Platform will meet your expectations
• That AI-generated content will be accurate, complete, or suitable for your purposes

10. Limitation of Liability

IN NO EVENT SHALL PITCH RISE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
